Terms of Service — Vibing in the Valley

Acceptance of Terms

By downloading, installing, or using Vibing in the Valley (“the App”), you agree to these Terms of Service. If you do not agree, do not install or use the App.

License

The App is licensed, not sold, to you. Jason Chalky grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control.

Intellectual Property

All content in the App — including code, artwork, music, dialogue text, and design — is the original work of Jason Chalky (with image assets generated with assistance from AI tools and curated by the developer) and is protected by copyright law. You may not copy, redistribute, resell, reverse-engineer, or create derivative works from the App’s assets or code without prior written permission.

User Content

Your save data — farm layout, inventory, friendships, and game settings — is your own. The App stores this content locally on your device and optionally in your personal iCloud container. We do not access, host, or claim any rights over your save data.

iCloud Sync

Vibing in the Valley uses Apple’s iCloud Key-Value Store for optional multi-device sync. By enabling iCloud sync, you agree to Apple’s iCloud Terms of Service and Privacy Policy. We are not responsible for iCloud service availability, data loss due to iCloud issues, or Apple’s handling of your iCloud data.

Optional AI Dialogue (BYOK Claude API)

The App includes an optional AI-powered NPC dialogue feature that requires you to bring your own Anthropic Claude API key.

You are solely responsible for your API key, associated costs, and compliance with Anthropic’s terms of service.
The developer is not a party to your relationship with Anthropic and does not process, mediate, or control any API traffic originating from your device.
The feature is off by default. Enabling it constitutes your acknowledgement that you understand usage will be billed to your Anthropic account.

Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Jason Chalky shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of — or inability to use — the App, including but not limited to loss of save data, Anthropic API charges incurred via the BYOK feature, or reliance on in-game information.

Changes to These Terms

We may update these Terms of Service from time to time. The “Last Updated” date at the top of this document reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the updated terms.
